Terms & Conditions

By accessing this website or booking with To Go Kenya Safari, you agree to be bound by these Terms. To Go Kenya Safari is a Kenya-registered company, and these Terms are governed by the laws of the Republic of Kenya.

Definitions: “Company / We / Us” means To Go Kenya Safari. “Client / You” means anyone booking or enquiring. “Tour” means any itinerary, transfer, or accommodation we arrange, including packages in Kenya, Tanzania, Uganda and Rwanda.

1. Booking & Payment

  • Prices are quoted in USD and exclude international flights, insurance, tips, visas/permits, and personal expenses unless stated otherwise. We reserve the right to revise prices before a booking is confirmed. After confirmation, prices are guaranteed except for park fee increases, fuel levy changes, or currency movements exceeding 10%.
  • Park and conservation fees (KWS in Kenya, and equivalent authorities in Tanzania, Uganda and Rwanda) are set by government and may change without notice. Any increase between booking and travel is passed on to the client.
  • We accept bank transfer, M-Pesa, and major credit/debit cards. Bank charges and transaction fees are the client’s responsibility.

2. Travel Documents, Visas & Permits

You are solely responsible for holding a valid passport (at least 6 months’ validity beyond your travel dates, with sufficient blank pages) and all visas and permits required for every country on your itinerary. To Go Kenya Safari is not liable for denied entry, delays, or costs arising from inadequate documentation, including permit shortages outside our control.

Because our itineraries can cross Kenya, Tanzania, Uganda, and Rwanda, requirements differ by country and change without notice. Please confirm directly with the relevant government source before travel:

  • Kenya: Electronic Travel Authorisation (ETA), applied for online before arrival via the official Kenya immigration ETA portal.
  • Uganda: Single-entry eVisa, applied for online via the Uganda immigration portal before travel.
  • Rwanda: Visa applied for online via the Rwanda Directorate General of Immigration (Irembo platform), or on arrival depending on nationality.
  • Tanzania: A separate eVisa via Tanzania’s official immigration visa platform. Tanzania is not covered by any joint East African visa product.
  • East Africa Tourist Visa (EATV): A joint multiple-entry visa covering Kenya, Uganda, and Rwanda only (not Tanzania), valid for 90 days and non-renewable. It must be applied for through the immigration authority of whichever of the three countries you enter first.
  • Rwanda gorilla trekking: Requires a separate gorilla trekking permit from the Rwanda Development Board, distinct from your visa. Permits are strictly limited and should be secured 3–12 months ahead depending on season; pricing is government-set and subject to change. We will advise current permit costs and availability at the time of booking, but cannot guarantee availability if you book late.
  • Yellow fever: A vaccination certificate is required for entry to Kenya, Uganda, and Tanzania for travellers arriving from or transiting certain countries. Check current requirements with a travel health professional.

We recommend applying for all visas and permits at least 4–6 weeks before departure (longer for gorilla permits).

3. Health, Fitness & Safety

Consult a travel health professional before departure; Kenya, Tanzania, and Uganda carry malaria risk. Some activities (walking safaris, gorilla trekking, boat safaris) require reasonable fitness, please disclose any medical condition, disability, or dietary need at the time of booking. We reserve the right to decline participation in an activity on safety grounds.

Wildlife behaviour is unpredictable. You must follow your guide’s instructions at all times; we are not liable for injury, loss, or death arising from failure to do so, or from the inherent risks of wildlife viewing. Wear seatbelts where fitted; standing through vehicle roofs is at your own risk.

4. Travel Insurance

Comprehensive travel insurance covering medical evacuation, trip cancellation, and personal liability is strongly recommended, and may be mandatory for gorilla trekking or other high-risk activities. We are not liable for costs your insurance would otherwise have covered.

5. Itinerary Changes & Force Majeure

We may alter itineraries due to road conditions, weather, wildlife movement, park regulations, or safety concerns, always aiming to provide an equivalent alternative. Neither party is liable for failures caused by events beyond reasonable control (pandemics, government action, civil unrest, strikes, border closures); refunds in such cases are assessed case by case.

6. Liability

We act as agent for third-party hotels, lodges, airlines, and activity operators across all countries we operate in, and are not liable for their acts or omissions. To the extent permitted under Kenyan law, our total liability for any claim is capped at the amount you paid for the affected service. We exclude liability for: your own negligence, theft of personal belongings, force majeure, government or border actions, third-party service providers, and civil unrest or terrorism.

7. Responsible Tourism

Clients must respect local communities and customs, never harass wildlife, follow park and guide rules, avoid purchasing illegal wildlife products, and minimise environmental impact. We reserve the right to terminate a safari without refund for abusive, illegal, or unsafe conduct.

8. Photography, Privacy & Website Use

We may photograph tours for marketing purposes; please tell your guide at the start of the tour if you’d prefer not to be included. Personal data is handled in accordance with our Privacy Policy and Kenya’s Data Protection Act, 2019. All website content is our copyright; commercial reuse requires our written consent. We aim to keep pricing and availability current but cannot guarantee it, please confirm details before booking. We are not responsible for third-party linked sites.

9. Complaints, Governing Law & Amendments

Please raise complaints with your guide or our operations team immediately. Written complaints submitted after the tour must reach us within 30 days at info@gokenyasafari.com, and we respond within 14 business days. These Terms are governed by Kenyan law; disputes are subject to good-faith mediation first, then the courts of Kenya. We may update these Terms at any time; continued use of our website or services after changes are published constitutes acceptance.
